Lawsuits and Legal Maneuverings Continue to Plague Fernbrook Resort Freelton

 

The Great and Powerful Rooster was back in action yesterday. As He was unusually tight-beaked all we know for certain is that Rooster attended a lawyer’s office. That Rooster claimed to have been defamed on an internet blog. And that the lawyer rejected His claim. Because we don’t know exactly what transpired between A and Z we’re going to have to use some deductions to determine exactly what happened.

"My name is being defamed," crowed Rooster (whose real name isn't Rooster).
“Monsieur Law Cat Junior,” said an indignant Rooster, “I have been mortally defamed,” He continued with crocodile tears in his eyes, “my Undesirable Neighbour wrote in an internet blog that my friends like cock.”

“Hmmm hhhmmm,” mused Law Cat Jr., “but cock is just another name for a Rooster… kind of like dick is just another name for Richard. It’s not defamatory. It’s just popularly accepted usage.”

“But I don’t like it. I want to sue the Undesirable Neighbour. Where do I go to get my money?” asked Rooster.

“Hmmm hhhmmm,” mused Law Cat once more, “Your real name isn’t Rooster? Is it? So why do you think that blog is about you? If you’re not really some stupid cock?”

“I don’t think it’s about me. Everyone else thinks it’s about me. EVERYONE!”

“Hmmm hhhmmm,” mused Law Cat again, “And have you ever dropped dog faeces or trespassed or vandalized or stolen or… or…”

“Of course not,” interrupted Rooster angrily. “None of that has ever happened. It’s all completely made up. COMPLETELY!”

“Hmmm hhhmmm,” mused Law Cat, “So if you name’s not really Rooster and none of these crimes have ever been committed by you or anyone at Fernbrook Resort than why do you think that these badly written unfunny and terribly boring internet stories are about you?”

“Because some people make chicken wing motions with their arms when they see me. Other people cluck loudly like a chicken. And kids point at me and start crowing like a Rooster. So I shake my wing at them. But they just laugh and run away.”

“Hmmm hhhmmm,” mused Law Cat, ‘Now, this Undesirable Neighbour family you speak of, how do you know they’re posting stories to the internet and that the stories are specifically about you? Your name is not Rooster. You haven’t done any wrong… according to you. Have they ever admitted to posting these stories? Have they ever complained about having dog faeces dumped daily on their lawn? Of trespasses? Of harassment?”

“No,” agreed Rooster.

“Hmmm hhhmmm,” mused Law Cat, “Well, if your name is not Rooster, you haven’t committed these crimes AND no one has ever accused you of committing a crime or even complained that a crime has been committed against them… than how do you even know who wrote these… these… trite and tiredly droll tales.”

“Because I just know. That’s how. No more questions. Everyone in Fernbrook obeys me without question and I order you to do the same. Now I want my suing money know please. Preferably in fifties and hundreds,” ordered Rooster.

“Hmmm hhhmmm,” mused Law Cat, “Well, though I am happy to take your money, I don’t see any case here. And if you were to accuse someone falsely then any ‘suing money’ as you call it… it would go to them.”  
  
“That’s stupid,” screamed Rooster, “And you’re stupid. The Lord Mayor of Fernbrook Resort Freelton was right. Cat’s are stupid.”

“Hmmm hhhmmm,” mused Law Cat, “I think what we have here is a case of a guilty conscience. You have been harassing and bullying a Neighbour whose Undesirability quotient is being brought into disrepute. And now you are trying to use me to harass them further.”

“You’re stupid,” said Rooster.

“Yes, Yes, quite,” mused Monsieur Law Cat. “I think SOME Fernbrook residents see themselves in these blog posts and, those residents, instead of pleaing a mea culpa, get angry. And indignant. As an example, the person who loudly complains of being falsely accused of not cleaning up after their pet, even though they have not been formerly accused and no one has even complained, is showing that they’re feeling guilty about something.”

“That’s just stupid.”

“And people who promise to help others as repayment for numerous gifts but continually renege on that promise, instead of making good, might claim to others that they have helped. And that a certain Undesirable Neighbour is extremely ungrateful. Though it is the opposite of reality. And truth. Because they have been taking advantage of someone but claim the opposite is true.”  

“That’s even more stupider.”

“Or if someone takes things and promises to pay but never does then those people might feel embarrassed and so claim that they are being wronged when the subject is broached. And so accuse the accuser of being rude to them. To direct attention from the facts and away from themselves.”    

“That’s even more stupid than more stupider,” crowed Rooster angrily. “I’m leaving.”

Rooster than got up to depart. But kept banging into the wall.

“That’s a wall,” mused Law Cat, “You have to use the door to exit the room. Over there,” he pointed with his paw. “It has a round knob projecting from it.” Then, after a long pause, “You have to turn it. Turn the knob. Have you never used a door before?”

“Shut up stupid,” the Great and Powerful Rooster mumbled tearfully to himself.   


Maybe that last part about the door was embellishment. Roosters prefer windows. OPEN windows. Don’t want to get sued.

But the Fernbrook Resort Freelton Chicken War is under way.




It looks like its just about that time...

Telling the Truth May Lead to a Lawsuit at Hyper-Sensitive Fernbrook Resort Freelton

"You are so sued!"
No doubt constant readers will remember the true tale (see: http://fernbrookresort.blogspot.ca/2016/10/keep-your-hands-off-my-pussy-fernbrook.html) of an unnamed Fernbrook Resort Freelton neighbor, referred to as the Silences, who, allegedly, banned their family from conversing with Neighbour Undesirable. And then confined their cat to the house when that same nieghbour was seen giving the hungry pussy a few strokes of attention.

Well, the tale just got stranger.

"Boo hoo hoo hoo,: cried Nancy the neighbour, "Telling the truth about me has hurt my feelings!"
Allegedly an unnamed Fernbrook Resort Freelton family contacted a lawyer. Feeling that the tale in question - “Keep Your Hands Off My Pussy!” Fernbrook Resort Freelton Neighbour Loudly Declares - was a slur on their good name. Even though no one was named in the tale. 

Perhaps their name isn’t that good. 

Anyway, their lawyer agreed with them (not about their name being no good [though no doubt he suspects that] but the part about being mortally defamed. That someone saying that an unnamed someone similar to them that did not allow their family to talk to a neighbor or allow their pussy out to be petted, was indeed grounds for a lawsuit. 

But then if I was charging two hundred bucks an hour no doubt I would agree with my client as well.
Though it does raise one question… why on earth would anyone think that the aforementioned story was about them? … Unless of course that is that they had actually told their family NOT to talk to someone AND/OR suddenly stopped allowing their cat outside.

And if they did, then how can they claim defamation? Or request damages?  

Because in this particular instance the truth is actually a defense against defamation.

And if the story is not true, how can they prove the unnamed family in the story is actually them? And again if they could ever do that, what damages could they expect when they did find the name of whomever was spreading these awful and hideous slurs about them? Not letting your pussy out to wander. INDEED! How hurtful. No doubt they’d win some valuable pocket lint and a half eaten roll of Lifesavers™ because their feelings were so so terribly hurt and they could no longer sleep at nights. 

Hypothetically, if I were the accused, I would ask the complainant just two questions. The first would be to detail conversations that each member of that family had had with the accused. And, the second, how often they allowed their pussy out for some air.

But I’m sure they would have some sort of excuse for both if the responses were indeed negative. As I suspect they would be.

Funny thing is… ever since that story ‘ “Keep Your Hands Off My Pussy!” Fernbrook Resort Freelton Neighbour Loudly Declares ’ was published not one resident in the Pine Cone Smoking Land of Fernbrook Resort Freelton has ever seen the Silences cat pussy footing around outside.

How’s that for a coincidence.

So good luck with that lawsuit. I hope your shady lawyer bilks you worse than a guilty client in a John Grisham novel. And I only hope that because you deserve it. And if you have any money left over when the case is settled … Go buy yourself a case of hair conditioner and a crate of epidermis thickener you whiny hypersensitive selective-memoried little nancy.

  (On a sidebar – did you know that in Ontario referring to someone a homosexual, gay, queer etc. is grounds for a lawsuit. Defamation, mental anguish, harassment, loss of affection etc. And if you’re fortunate you can settle out of court with a tidy untaxable sum and retire (perhaps at a young age) and never have to work again?”)

OscarÒ nominated actress Mila Kunis has been publicly accused of stealing a pet chicken (named Doggie) from childhood friend Kristina KaroÓ. Karo claims that this heinous deed happened when the pair were seven year old best friends. And that 25 years later the accumulated emotional trauma is worth exactly $5,000 to her. Ms. Kunis has vehemently denied the theft. And on TMZ she decided to elaborate on the true nature of the incident.





"I didn’t steal no chicken… " an emotionally distraught Mila Kunis announced to a bemused world, "I rescued him!"

Then, after a brief pause Kunis added, "The chicken in question, Doggie, came to me and said that Kristina had been torturing him. Forcing him to listen to her sing and watch her dance… and that… and that he just couldn’t take it any more… that he was going to donate his wings, drumsticks and white meat to the Colonel Sanders Institue for Culinary Research," she said with tears glistening in her eyes.



"I hated seeing Doggie discouraged like this… normally he was so cluckin’ happy… so I hatched a plan. Using my Etch-a-SketchÔ I drew Doggie a passport and an exit visa. Next I counterfeited him some money out of Play-dohÔ . Then I put him on my tricycle and sped to the airport where I smuggled him onto a plane headed for the great nation of Fernbrook Resort. A place where chickens roam without fear of reprisals… and without any fear of being sung to by a… a demented…" Kunis trailed off.

But that wasn’t all, Ms Kunis said that this one act of mercy was a defining moment in her life.

"Under the guise of an actress," she said, "ever since I have been roaming the world rescuing chickens, geese, ducks… even some Cornish Game Hens… and sending them to Fernbrook Resort… creating a United Nations of Fowl."

When asked if she considered herself to be the Oskar Schindler or Raoul Wallenberg of the chicken world she replied, "Say what… ?"

Ms. Kunis also commented on her plans to fight the absurd claim.

"Doggie, who now operates a Dry Cleaning business in Fernbrook Resort, has been in touch with me. He’s offered his support and has also agreed to testify on my behalf should the case go to trial." She smiled with relief.



Kunis finished the interview stating: "I think the world needs more Doggies," before breaking into a fresh round of tears.

TV Critics, Lawsuits and Hypocrisy at Fernbrook Resort Freelton

Emergency rooms right across North America were filled with injured entertainment critics who had hacked off their thumbs after viewing the so-called epic mini-series: Fernbrook Resort Freelton - History of a Canine Ruled Nation.

"Well, it’s official," stated a sober Larry King, "March 27, 2015 at 8:05 PM Eastern Standard Time entertainment officially died. May Steven Spielberg have mercy on us all."

Remarked Roger Ebert: "This is the kind of programming that makes radio so popular…"

"Well, that’s twelve hours of my life I’m not gonna get back," tweeted Abraham Lincoln about the lengthy series.

"Why won’t my eyes stop bleeding?" sobbed Stephen King.

While Jerry Seinfeld tweeted, "If I wrote something like this I’d be back behind bars."

But perhaps the Attorney General for the nation of Fernbrook Resort said it best when he threatened: "WE’RE GONNA SUE!"

Yeah, that’s right, the legal council for the great nation of Fernbrook Resort, who obtained his degree from a soggy matchbook cover he found on a street corner, is suggesting legal action against not only the producers of the mini-series but also the publication that inspired the series, ‘Secrets of Fernbrook Resort’.

"They’re making us look bad," stated the Attorney General, "and let me tell you this – we are not a people that needs any help when it comes to making ourselves look bad."

When asked exactly how the internet publication and/or the mini-series made Fernbrook Resort look bad the AG replied, "by telling the truth. Telling the world that we stand for regularly tossing dog feces at our neighbors homes. That we steal from our neighbor’s. That we vandalise our neighbor’s property. We rifle through their garages. And toss our garbage into their yards. Because it is perfectly okay to do such things… but telling the entire world that we do such things is not okay! We will not stand for this!"

The Attorney General for the beleaguered nation went on to confirm that the aggrieved citizens were circulating petitions against the alleged perpetrators of Secrets of Fernbrook Resort, in an attempt to have them evicted, in addition to undertaking legal action for slander.

Said Doc Ballard (the Lord Mayor of Fernbrook Resort) after watching the highly rated mini-series, "Agreed. The one thing Fernbrook won’t stand for is those who would dare smear our good nation’s name with the truth. It is our Dog-given right to do unto others those things that others better keep their traps shut about… or else… because we’re a nation of hypocrites."
